Permission statement

We have the following permissions under Consumer Credit regulations; credit broking, debt administration, debt-collecting, entering into regulated consumer hire agreements as owner and exercising or having the right to exercise the owner's rights and duties under a regulated consumer hire agreement. Our permitted business also includes introducing, advising, arranging, dealing as agent and assisting in the administration and performance of general insurance contracts. 

Our Service

We act as an intermediary in arranging vehicle finance with your lender and insurance cover with your insurer. We will take your reading of these Terms of Business and your instructions to arrange finance and insurance cover to indicate that you understand and have given your consent for us to operate in this way. We will not in any circumstances act as a lender or as an insurer nor guarantee or warrant the solvency of any lender or insurer.

Products offered

We work with a number of carefully selected credit providers who may be able to offer you vehicle finance. We are only able to offer finance products from these providers. All finance is subject to status and income which will involve these providers undertaking identity and credit checks on you. 

Our insurance product is arranged by Lloyd Latchford Insurance Brokers Ltd and primarily underwritten by National Insurance and Guarantee Corporation Ltd (NIG). Your insurance underwriter, if different to NIG, will be confirmed in your policy documentation. 

Providing information to your insurers

Any insurance obtained is based upon the information provided to the insurance company on application.  Unless otherwise indicated by the specific insurer underwriting your particular policy, the following circumstances apply.

For Consumers (individuals buying insurance wholly or mainly for purposes unrelated to their trade, business or profession) this means that you must take reasonable care to answer all questions fully and accurately. Once cover has been arranged, you must immediately notify us of any changes to the information that has been provided to your insurers. Failure to provide accurate and up to date information may invalidate your insurance cover and mean that a claim may not be paid.

All other customers must disclose all ‘Material Facts’ (any information that may influence the insurer’s decision over cover or terms) prior to inception and throughout the period of insurance. Failure to disclose material information may invalidate your insurance cover and could mean that a claim may not be paid.

Fees and charges

The charges for products and services offered are set out in our quotations and credit agreements. We are remunerated by commission from the relevant suppliers for arranging your insurance.  We may also make commission payments to third-party introducers for referring business to us which will be included in the quoted and final rental price we agree with you. You may ask us to explain our fees to you at any time.

Premium payment

Where applicable, your insurance premium is included in your monthly rental price. 

Awareness of Terms and Conditions

It is your responsibility to read your Credit agreement and any insurance policy documents to satisfy yourself that these meet your requirements. Should you have any queries, or concerns, please contact us immediately.

How to cancel

You have a statutory right to cancel your credit agreement and insurance cover within the first 14 days of entering into the agreement, known as the cooling off period.  Please refer to your credit agreement, insurance policy or renewal documentation for further details.  If you wish to cancel outside this period cancellation rights will be as detailed in your documents. 

Protecting your money

Prior to your insurance premium being forwarded to the insurer, and for your protection, we hold your money as an agent of the insurer, in which case your insurance is treated as being paid for.  We reserve the right to retain interest earned on this money. We may need to transfer your money to another intermediary in some cases in order to complete the arrangement of cover for you.  However your money will be protected at all times because of our requirements under the FCA rules. We will take your reading of these Terms of Business and your instructions to arrange cover, to indicate that you understand and have given your consent for us to operate in this way.

Protecting your Personal Data (data)

Our Privacy Policy outlines how we will use your data. We are the Data Controller for the data you provide to us and are responsible for ensuring we use your data in accordance with the relevant data protection laws. We use your data in order to arrange your credit agreement, any insurance and associated products as well as for marketing purposes (you may opt-out of receiving marketing at any time as per our Privacy Policy).  We may pass your data to other organisations, such as insurers, auditors, external consultants, credit providers, banks, financial transaction processors, crime and fraud prevention agencies and databases and regulators. We process all data in the UK but where we need to disclose data to parties outside of the UK we will take reasonable steps to ensure the privacy of your data. In order to protect our legal position, we will retain your data for a minimum of 7 years. You can request copies of the data we hold, have it corrected, sent to a third party or deleted (subject to our need to hold data for legal reasons). If you have any questions regarding how we process your data, if you would like to exercise your rights or make a complaint you can do so by emailing ukprivacy@sgfleet.com or writing to us at our address in the About us section.  If you are not satisfied with our response or believe we are processing your data incorrectly you have the right to complain to the Information Commissioner’s Office at Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF or telephone 0303 123 1113.

Complaints

We strive to provide a high level of service at all times.  However if you have reason to make a complaint about our service you should contact the Consumer Service Team on 0344 85 45 161 or by emailing consumer@sgfleet.com. A copy of our complaints policy is available upon request. If we are unable to resolve your complaint satisfactorily, you may be entitled to refer the matter to the Financial Ombudsman Service (FOS).  Further information is available by calling the FOS on 0800 023 4567 or at http://www.financial-ombudsman.org.uk.

Compensation arrangements

We are covered by the Financial Services Compensation Scheme (FSCS) in respect of any insurance cover arranged.  You may be entitled to compensation from the scheme if we cannot meet our obligations. This depends on the type of business and the circumstances of the claim.  Insurance advising and arranging is covered for 90% of the claim without any upper limit.  For compulsory classes of insurance, insurance advising and arranging is covered for 100% of the claim, without any upper limit.  Further information about compensation scheme arrangements is available from the FSCS on 0800 678 1100 or at http://www.fscs.org.uk.
